REGULAR MEETING- MINUTES
WEDNESDAY, JULY 14th, 2010
The Council of the Rural Municipality of Clanwilliam held its regular meeting duly assembled in the Council Chambers of the Town of Erickson on Wednesday, July 14th, 2010 at 9:00 am.

1.Call to Order;
Reeve Baraniuk called the meeting to order at 9:07 am.
Adoption of the Agenda;

a) List of Accounts for Approval;

Be It Resolved That Council approve the payment of the June 2010 accounts as recommended by the Finance Committee and as represented by cheque no.’s 4664 to 4756 inclusive and totalling $ 207,181.06 from the General Account of the R.M. of Clanwilliam.

Be It Resolved That Fred Swiscoski be hired for Roadside Mowing at an hourly rate of $14.50 starting immediately.

MADUKE - SYNCHYSHYN
Whereas: Alden Larsen owner(s) of the property legally described as being;
NW 21-17-17W
and located in the Rural Municipality of Clanwilliam, applied to the Council in accordance with Section 55(1) of The Planning Act, to vary the minimum requirements of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86 as amended as it applies to this property, as follows:
To vary the Minimum Requirements for:
Front Yard from 125ft. to 82ft.
For the purpose of: To allow for a 16’ addition onto existing shop so that it may conform to the Rural Municipality of Clanwilliam Zoning By-Law No. 1313-86 as amended.
And after careful consideration of the application and any representations made for or against the variation sought by the applicant, the Council of the Rural Municipality of Clanwilliam, in a meeting duly assembled this 14th day of July 2010.

This variation order shall expire if not acted upon within 12 months of the date of approval. Prior to the expiry of the 12 month approval period, it may be extended for only one additional period not exceeding 12 months, at the discretion of Council.

Be It Resolved that Council for the Rural Municipality of Clanwilliam approve the extension of the turnaround circle to the edge of Lot 95 in the Otter Lake Subdivision.

Be It Resolved that Council of the Rural Municipality of Clanwilliam does not object to the road located South of the well in the Otter Lake Subdivision being donated to the Association.

Be It Resolved That Council authorize the ordering of 6 RM hoodies & 6 RM zippered jackets from Kimbroidery.

c) MTS – Rights-of-Way application;

Be It Resolved That the Council of the RM of Clanwilliam agree to approve the application from MTS for the following work to construct new MTS facilities to replace defective drop to J. Martin, NE 4-17-17W:
Directional bore new MTS cable under municipal road at NE 4-17-17W. Minimum depth of cable 1 meter below lowest point of ditch. Place new MTS pedestal on south side of road .3m line of RA. Plow new drop to customer.
Be It Further Resolved that the C.A.O. complete the application and return to Manitoba Telecom Services.
Be It Further Resolved that MTS be responsible for any road or culvert damage.

d) Lot 317, Otter Lake – V. Bodie;
Resolution No. 189/10
NYLEN – MADUKE
Whereas V. Bodie, owner of Lot 317, Otter Lake has requested that a holding tank not be a requirement on her lot because there is no plumbing or running water;
Therefore Be It Resolved That Council agree to enter into an agreement with V. Bodie that as long as the property does not have any plumbing or running water, a holding tank will not be required;
Be It Further Resolved That a holding tank, compliant with the Otter Lake Development Agreement, is to be installed prior to the sale of this property.
Be It Further Resolved that Reg Montgomery and the Association be notified that no water is to be connected to this lot until a holding tank is installed.

e) Proposed Subdivision – Beatty’s;

Whereas an application for subdivision was submitted by Venton & Marlenne Beatty, registered owner(s), to subdivide Pt. N.E. ¼ Sec. 30-18-18 WPM in the R.M. of Clanwilliam
And Whereas the application for subdivision was forwarded to various government departments for comment by Intergovernmental Affairs, Agriculture and Community Planning Branch
Be It Resolved That Council for the R.M. of Clanwilliam approve the application for subdivision to subdivide Pt. N.E. ¼ Sec. 30-18-18 WPM.
The following conditions will apply:
1. That a conditional use order be obtained to provide for the non-farm single family dwelling within the “A80” Zone. That setbacks of 200 feet for dwellings and 100 feet as a natural vegetation buffer from the high water line of Otter Lake be observed as per the RM of Clanwilliam Zoning Bylaw.
- That a variation order be approved reducing the minimum site are requirement, for an agricultural activity with the “A80” Zone from 80 acres to 75 acres.

Be It Resolved That the R.M. of Clanwilliam cover the cost of the insurance deductible to repair Ryan Beatty’s camper trailer at a cost to be split equally with the Town of Erickson.

Be It Resolved That Council approve the purchase of 3 loads of gravel to be placed around the pit at the Waste Disposal Grounds.
Be It Further Resolved that enough wire fence be purchased to complete the fencing project and that the cost be split equally with the Town of Erickson.

Be It Resolved That an approach be built on the West side of Highway 10 to access SE32-17-18 and the cost be split equally with the Town of Erickson.

Be It Resolved That Council approve the widening of the approach and extension of the culvert on the approach at NE19-18-18.
Be It Further Resolved that the road is repaired at NE17-18-18.

m) Disaster Financial Assistance;

Whereas the R.M. of Clanwilliam suffered damage from overland flooding to public (municipal) property due to heavy rains in the Spring of 2010;
Therefore Be It Resolved that Council request Disaster Financial Assistance to cover eligible costs to restore infrastructure and property to a functional state.

Be It Resolved That Council authorize Dave Maduke to have 4 loads per mile C-Base installed for 1 mile on Road 101 North, and 2 miles on Road 99 North, and that it also be gravelled.
