RURAL MUNICIPALITY OF CLANWILLIAM

REGULAR MEETING- MINUTES

WEDNESDAY, AUGUST 11TH, 2010

 

The Council of the Rural Municipality of Clanwilliam held its regular meeting duly assembled in the Council Chambers of the Town of Erickson on Wednesday, August 11, 2010 at 9:00 am.

 

Members Present:             Reeve Victor Baraniuk;

Councillor Jim Nylen;

Councillor Dave Maduke;

Councillor Les Woloshen;

Councillor Mitch Synchyshyn;

CAO Kat Bridgeman;

 

  1. Call to Order;

Reeve Baraniuk called the meeting to order at 9:00 pm.

 

  1. Adoption of the Agenda;

Be It Resolved that Council adopt the minutes of the Regular Meeting of July 14th, 2010 as circulated.

Be It Resolved That Council approve the payment of the July 2010 accounts as recommended by the Finance Committee and as represented by cheque no.’s 4757 to 4810 inclusive and totalling $ 49,991.09 from the General Account of the R.M. of Clanwilliam.

Be It Resolved That Council approve the indemnities and expenses for council members for July 2010 as follows:

Councillor Les Woloshen                 $ 300.00;

Be It Resolved That Council for the Rural Municipality of Clanwilliam approve the Unaudited Financial Statement for the Month of July 2010 as presented.

Mr. Reg Montgomery attended the meeting to discuss with Council the proposed changes to the Otter Lake subdivision.

a)     Auditor Appointment;

WOLOSHEN - SYNCHYSHYN

 

Whereas it is necessary for the R.M. of Clanwilliam to engage an auditor for the review of the 2010 fiscal year;

 

Be It Resolved that the R.M. of Clanwilliam will hire the accounting firm of Meyers, Norris and Penny to conduct this audit.

b)     Viking Classic Golf Tournament – donation request;

Be It Resolved That the Public Hearing does now adjourn at 9:40 am and that Council continue with the Regular Meeting.

Resolution No. 212/10

Nylen - woloshen

 

Whereas Henry & Betty Wikdahl owners of the property legally described as Pt. SE ¼ 16-18-18 WPM in the Rural Municipality of Clanwilliam, and located at the crossroads of Municipal Rd. 104N and Provincial Hwy. 262, has applied to the Council in accordance with Section 53 of The Planning Act for approval of a Conditional Use in order to provide for the location of a Non-Farm Single Family Dwelling within the “A80” General Agricultural Zone, in accordance with the provisions of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86;

 

And after careful consideration of the application and any representations made for or against the proposed Conditional Use sought by the applicant, the Council for the Rural Municipality of Clanwilliam in a meeting duly assembled this 11th day of August 2010.

 

APPROVE the said Application for Conditional Use.

Whereas: Henry & Betty Wikdahl owners of the property legally described as being;

SE ¼ 16-18-18

and located in the Rural Municipality of Clanwilliam, applied to the Council in accordance with Section 55(1) of The Planning Act, to vary the minimum requirements of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86 as amended as it applies to this property, as follows:

 

To vary the Minimum Requirements for:

 

Reduce required distance of 1320 feet for existing livestock confinement to 780 feet from house.

 

For the purpose of: To allow for existing livestock confinement located on SW ¼ 15-18-18 so that it may conform to the Rural Municipality of Clanwilliam Zoning By-Law No. 1313-86 as amended.

 

And after careful consideration of the application and any representations made for or against the variation sought by the applicant, the Council of the Rural Municipality of Clanwilliam, in a meeting duly assembled this 13th day of April 2010.

 

            Approved  the said Application for Variation

 

Approval is given subject to the following conditions: N/A

 

This variation order shall expire if not acted upon within 12 months of the date of approval.    Prior to the expiry of the 12 month approval period, it may be extended for only one additional period not exceeding 12 months, at the discretion of Council.

Be It Resolved That Council approve the purchase of a fridge from Carrousel Trading for the Fire Department;

Whereas: Venton & Marlene Beatty owners of the property legally described as being;

PT. NE ¼ Sec. 30-18-18 WPM

and located in the Rural Municipality of Clanwilliam, applied to the Council in accordance with Section 55(1) of The Planning Act, to vary the minimum requirements of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86 as amended as it applies to this property, as follows:

 

To vary the Minimum Requirements for:

 

To reduce minimum site requirement from 80 acres to 75 acres for an agricultural activity within the A80 zone.

 

For the purpose of: To conform to the Rural Municipality of Clanwilliam Zoning By-Law No. 1313-86 as amended.

 

And after careful consideration of the application and any representations made for or against the variation sought by the applicant, the Council of the Rural Municipality of Clanwilliam, in a meeting duly assembled this 11th day of August 2010.

WOLOSHEN - SYNCHYSHYN

 

Whereas Venton & Marlene Beatty owners of the property legally described as Pt. NE ¼ Sec. 30-18-18WPM in the Rural Municipality of Clanwilliam, and located at the north end of Ditch Lake, has applied to the Council in accordance with Section 53 of The Planning Act for approval of a Conditional Use in order to provide for the location of a Non-Farm Single Family Dwelling within the “A80” General Agricultural Zone, in accordance with the provisions of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86;

 

And after careful consideration of the application and any representations made for or against the proposed Conditional Use sought by the applicant, the Council for the Rural Municipality of Clanwilliam in a meeting duly assembled this 11th day of August 2010,

 

APPROVE / DENY the said Application for Conditional Use.

 

Approval is given subject to the following conditions:

 

1)     Setbacks of 200 feet for dwellings and 100 feet to be observed as a natural vegetation buffer from the high water line of Ditch Lake.

Be It Resolved That Council  amend condition (l) in the proposal to subdivide Pt. S ½ 35-17-18 & SW ¼ 36-17-18 being Block 2, 3, 4 & 5, Plan 48448 NLTO as follows:

 

That Lot 7, Block 6 be deleted and shown as part of Lot 26, Block 6

 

That Lot 8, Block 6 remain as a proposed lot

 

Be It Further Resolved That the Public road running along the south side of Block 1 be turned into a lot.

Be It Resolved that the Regular Council Meeting does now adjourn at 11:40 am

Next meeting scheduled for Wednesday, September 8th, 2010 at 9:00 am.
