REGULAR MEETING - MINUTES

The Council of the Rural Municipality of Clanwilliam held its regular meeting duly assembled in the Council Chambers in the Town of Erickson on Wednesday, March 10th, 2010 at 9:00 am.

Call to Order;
Reeve Victor Baraniuk called the meeting to order at 9:00 am.

Be It Resolved That Council approve payment of the February 2010 accounts as recommended by the Finance Committee and as represented by cheque no.’s 4467 to 4513 inclusive and totalling $27,217.56 from the General Account of the RM of Clanwilliam.
Be It Further Resolved That cheque No. 4502 to Beatty Construction in the amount of $2396.63 be removed from the list of accounts for further review.

SYNCHYSHYN - MADUKE
Whereas Betty Woywada owner of the property legally described as NW ¼ Sec. 26-17-17WPM in the Rural Municipality of Clanwilliam, and located approximately 8 miles East of PTH No. 10 on PR 357 (Mountain Road) and ½ mile North on Municipal Road 98 W, has applied to the Council in accordance with Section 53 of The Planning Act for approval of a Conditional Use in order to provide for the location of a Non-Farm Single Family Dwelling within the “A80” General Agricultural Zone, in accordance with the provisions of the Rural Municipality of Clanwilliam’s Zoning By-law No. 1313-86;
And after careful consideration of the application and any representations made for or against the proposed Conditional Use sought by the applicant, the Council for the Rural Municipality of Clanwilliam in a meeting duly assembled this 10th day of March 2010,
APPROVE the said Application for Conditional Use.

Be It Resolved That the Council for the Rural Municipality of Clanwilliam recess the Regular Meeting of Council at 10:00 am to sit as a Public Hearing to hear any representation on a proposal to subdivide land which results in the creation of a new public road.

Resolution No. 60/10
SYNCHYSHYN - MADUKE
Whereas an application for subdivision was submitted by Warren & Kim Boles, registered owners, to subdivide S.W. ¼ Sec. 2-18-18 WPM in the R.M. of Clanwilliam;
And Whereas the application for subdivision was forwarded to various government departments for comment by Intergovernmental Affairs, Agriculture and Community Planning Branch
And Whereas pursuant to Section 125(2) of the New Planning Act, a Public Hearing was held on the proposed subdivision in accordance with Section 169;
Therefore Be It Resolved That Council for the R.M. of Clanwilliam approve the application for subdivision to subdivide S.W. ¼ Sec. 2-18-18 WPM.
The following conditions will apply:
- The Appropriate tests regarding water supply for all proposed lots be provided to and approved by Council.
- That the applicant provides a road and drainage design approved by a qualified engineer.
- That the public reserve along the lake be increased to at least 30m (100’) or the proponent enter into a development agreement with Council in regards to Manitoba Water Stewardship’s recommendations.
- That the developer enters into a development agreement with Council, which is to be registered as a caveat on the titles to the new lots.

Be It Resolved That the CAO be authorized to attend the Manitoba Municipal Administrators Association Convention in Winnipeg from April 25th – 28th, 2009.
Be It Further Resolved That Council authorize the payment of any expenses incurred in accordance with the Indemnity By-law.

Be It Resolved That the 2010 Road Gravelling Program for the RM of Clanwilliam be tendered with a submission deadline of April 12th, 2010.

Be It Resolved That Council for the RM of Clanwilliam authorize the following to attend the Municipal Officials Seminar in Brandon on April 14th & 15th, 2010:
Council as a Whole and the CAO;
Be It Further Resolved that all expenses be paid in accordance with the Indemnity By-Law.

Be It Resolved That Council reschedule the regular meeting of April 14th, 2010 to April 13th, 2010 at 9:00am.

d) Appeal – Montgomery – 10:30am;

Whereas Council had given the S.R.M.P.D. direction to issue a Stop Work Order to Reg & Shirley Montgomery for the moving in of a shed on their lot in Otter Lake without first applying for a permit;
And Whereas Mr. & Mrs. Montgomery has filed an appeal to the RM Council;
Now Therefore Be It Resolved That After reviewing the appeal, Council agrees to allow the shed to remain with the following conditions:
- The shed be sided with vinyl siding
- The building is to be shingled
- It must have a proper foundation
- the required permits Must be obtained by the SRMPD prior to any work commencing.

Whereas Council has received a letter requesting the forgiveness of taxes for 2008 and 2009 on NW ¼ 2-18-18 due to the lengthy subdivision process;
And Whereas Council has reviewed and discussed the request;
Now Therefore Be It Resolved That Council denies the request based on the fact that applications for subdivision are not guaranteed; nor are they to have an impact on the remaining taxpayers in the municipality during this process.
